Respondent(s) PRAYER This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of Certiorari, calling for the records of the 2nd respondent in his proceedings bearing Na.Ka.No.470/2024/A4 dated 20/01/2025 and of the proceedings of the 2nd respondent dated 25/09/2025 passed under Rule 8 of Revenue Standing Order 41 and to quash the same and to pass appropriate orders within a time frame fixed by this Hon'ble Court. ORDER

This writ petition is filed seeking to call for the records of the second respondent in his proceedings bearing Na.Ka.No.470/2024/A4 dated 20.01.2025 and the proceedings of the second respondent dated 25.09.2025 passed under Rule 8 of Revenue Standing Order 41 and to quash the same. 2.The case of the petitioner is that the petitioner is the lawful owner of the agricultural land in S.F.No.399/A1 & 399/A3, derived through a registered partition deed and has been continuously cultivating in the said lands for decades. The further case of the petitioner is that the second respondent issued a notice dated 20.01.2025 demanding seigniorage fees based on an alleged 1992 communication addressed to the petitioner's deceased father, without any assessment, particulars or opportunity of hearing.

Despite the petitioner's objections, attachments order dated 25.09.2025 was also passed for recovering a sum of Rs.86,280/- along with interest at 25% per annum from 12.10.1992. Challenging the above said notice dated 20.01.2025 and attachment order dated 25.09.2025, the present writ petition has been filed with the above said prayer. 3.The learned counsel for the petitioner would submit in order to give quietus to the issue, the petitioner is ready to pay Rs.

and after the receipt of the same, the second respondent may be directed to close the complaint as against the petitioner.

4.Per contra, the learned Additional Government Pleader appearing for the respondents would submit that the petitioner's father did not pay the seigniorage fees, which was claimed in the year 1992, thereby, the recovery order dated 20.01.2025 was passed and thereafter, on the basis of the recovery order, the present revenue recovery proceedings has been initiated for recovering a sum of Rs.86,280/- along with interest at 25% per annum from 12.10.1992. Therefore, he prays for dismissal of the present writ petition. 5.Heard both sides and perused the materials available on record. 6.It is seen that the notice claiming seigniorage fee was issued to the petitioner's father in the year 1992. However, till 2025, the respondents have not taken any action to recover the said amount from the petitioner's father.

Further, the impugned order is also passed against the petitioner's father, who is no more, hence, the same is not sustainable. However, in order to give quietus to the issue, the petitioner is now directed to pay a sum of Rs.86,280/-, without interest to the second respondent within a period of four (4) weeks from the date of receipt of a copy of this order and on receipt of the same, the second respondent is directed to close the complaint as against the petitioner's father.
