ORDER

This criminal original petition has been filed seeking expeditious disposal of CC.No.423 of 2025 pending before the Additional Mahila Court, Alandur, preferably within the period of three (3) months and to consequently, direct the respondent police to appear before the trial Court on all hearing dates.

Learned counsel for the petitioner submitted that the petitioner/defacto complainant lodged a complaint against the respondents 2 to 4 herein and on the basis of the said complaint, an FIR came to be registered in Crime No.32 of 2021 on the file of the 1 st respondent for the offences under Sections 498A and 506(2) of IPC r/w. Section 4 of the Dowry Prohibition 2/8

Act. On completion of the investigation on the said complaint, a charge sheet has been filed before the Additional Mahila Court, Coimbatore and the same was taken on file in CC.No.1143 of 2022. Learned counsel further submitted that, the offence took place on 19.09.2020, however, the charge sheet has been filed only in the year 2022 with a delay of two years, since the respondent police have become complacent with the accused and not conducted the investigation within the time, despite the petitioner making several representations, the respondent police have also not acted upon the same, taking advantage of the fact that the petitioner is a resident of Chennai.

Later, it was found that the Assistant Public Prosecutor who is appearing on behalf of the State before the trial court, had previously appeared for the respondents 2 to 4 and defended them. Therefore, the petitioner filed a transfer petition before this Court in Crl.OP.No.2087 of 2023 and pursuant to the order of this Court dated 06.02.

Thereafter, for the last ten hearings, there has been no progress, as the respondent police has not appeared before the trial court, despite the petitioner making representation to the Superintendent of Police, Coimbatore on 04.09.2025, with regard to the pendency of the case and also for not disclosing the CCTV footage as evidence, which are necessary to prove the case of the petitioner.

Learned Additional Public Prosecutor appearing for the 1 st respondent fairly submitted that admittedly, the petitioner is the victim and she had lodged a complaint and on her complaint, an FIR was registered in Crime No.32 of 2021 and after completion of investigation, charge sheet came to be filed before the Additional Mahila Court, Coimbatore in CC.No.1143 of 2022. He further submitted that, on the directions of this Court, the case has been later transferred to the file of Additional Mahila Court, Alandur and renumbered as C.C.No.423 of 2025 and totally, there are 4/8

seven witnesses in this case and the trial can be completed without any delay, preferably within a period of three months, if the witnesses co-operate with the trial proceedings. He also submitted that, NBW has been issued against A1 on 17.11.2025 and the next date of hearing is on 03.12.2025 and now, on the directions of the Superior Officers, a special team has been formed and A1 will appear before the trial court on the next date of hearing and appropriate progress will be reported in this case, on the next date of hearing.

Recording the above submission made by the learned Additional Public Prosecutor, this Court directs the trial court to complete the trial in C.C.No.423 of 2025 as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of a copy of this order. It is made clear that, if there is any laxity, appropriate action will be taken against the officials concerned.

5. Further, the Superintendent of Police, Coimbatore shall monitor the progress of the case. It is made clear that this Court has not gone into the merits of the case and it is for the trial court to consider the CCTV footage if any to be submitted on the part of the petitioner, at the time of evidence.

6. With the above directions, this criminal original petition stands disposed of. Registry is directed to mark a copy of this order to the Superintendent of Police, Coimbatore.
