ORDER

The petitioner, who was arrested and remanded to judicial custody on 03.09.2025, for the alleged offence punishable under Sections 103(1)(a) 191(2), 191(3) @ 103(1) of BNS, in Crime No.333 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that, due to previous enmity, he abducted the deceased to a secluded place and, after consuming liquor, joined with the other accused in attacking the deceased with a knife. It is further alleged that they subsequently disposed of the body in nearby bushes. Based on this complaint, the petitioner was arrested.

3. Learned counsel appearing for the petitioner submitted that the petitioner herein is ranked as A6 and he has not having any specific overt act. He further submitted that he has been falsely implicated in this case and is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally six accused, A1 to A5 was arrested and they are still in judicial custody. The petitioner herein is A6, was arrested on 03.09.2025. Originally, the case was registered under Section 103(1) of BNS @ 191, 192, 103(1) of BNS. During the course of investigation, it was revealed that the petitioner had actively participated in the offence, had conspired to commit the murder, and had also assisted the other accused in disposing of the body. Hence, he was arrested. However, he opposes to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record 2/5

including the First Information Report.

6. On perusal of the FIR and other connected materials, it is seen that accused A1 to A5 are also involved in this case and they have already been detained under Act 14 of 1982. The learned Government Advocate (Crl.Side) reported that the petitioner has no previous criminal antecedents; however, the investigation is at a crucial stage.

7. Considering the nature of the allegations, the submissions made by the learned Government Advocate (Crl. Side), and further, the fact that custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner.
