ORDER
This writ petition has been filed seeking to direct the 1st and 2nd respondents not to interfere with the possession and peaceful enjoyment of the petitioner over the subject property.

The case of the petitioner is that she is the owner of the residential building situated at R.S.No.21/5G, Patta No.292 K, East Street, Pettai Village, Thirunallar Commune Panchayat measuring an extent of 95 cents and the same was acquired by her, vide registered settlement deed dated 27.03.1992 bearing Doc.No.241 of 1992. While so, as there has been constant disturbance from the private respondents 3 to 6, the petitioner approached the respondent police/law enforcing agency seeking protection. However, the respondent Police have not given any protection to the 2/5
petitioner and had refused to register the petitioner's complaint. Hence, the present petition has been filed.

When the matter was taken up for hearing, the learned Public Prosecutor (Puducherry) appearing for the 1st and 2nd respondents submitted that submitted that there exists a civil dispute between the petitioner and the private respondents/counter parties with regard to the ownership of the subject property. He further submitted that on enquiry, it is found that the dispute is civil in nature and that a suit in O.S.No.237 of 2025 is also pending between the parties and that, the 2nd respondent had not interfered with the civil disputes between the parties. However, in the event of arising of any law and order problem, necessary action will be taken by the 2nd respondent.
4. Recording the above submission made by the Public Prosecutor (Puducherry), this writ petition (criminal) stands closed. However, the petitioner is at liberty to work out her remedy before the civil court in the manner known to law. It is made clear that if there is an infraction of law and 3/5
order, the respondent police are at liberty to initiate appropriate action in accordance with law. No costs. Consequently, the connected miscellaneous petition is closed.
