ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 14.09.2025 for the offences punishable under Sections 5(I), 5(j)(ii), 6 of POCSO Act, 2012 and Sections 4(1), 5(1)(a), 5(1)(b),5(1)(c) and 5B(2) of Immoral Traffic (Prevention) Act, 1956 and Section 98 of BNS in Crime No.25 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that, the victim girl got acquaintance with a women/ A1 and under the guise of offering a work for a day, A1 induced the victim girl to accompany her to Thanjavur; that thereby, the victim girl accompanied A1 to Thanjavur, where she was kept in a house and subjected to sexual assault by several men; that thereafter, the victim girl was forced into prostitution by A1; that thereby, the petitioner herein along with other accused had committed penetrative sexual assault on the victim girl. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial 2/4

custody since 14.09.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the victim girl is aged about 17 years at the time of occurrence; that the petitioner joining hands with other accused had committed aggravated penetrative sexual assault on the victim girl; that the bail petition of the co-accused/ A1 in Crl.O.P.No.29172 of 2025 was dismissed by this Court; and that the investigation of the case is pending. 5.

I have considered the submissions made on both sides and perused the materials available on record, including the 183 BNSS statement of the victim girl.

Considering facts and circumstances of the case, grave nature of offence, the disturbing facts recorded in the 183 BNSS statement of the victim girl and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 3/4
