ORDER

The petitioner herein, who was arrested and remanded to judicial custody on 25.09.2025 for the offences punishable under Sections 303(2), 326(a) of BNS in Crime No.7 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that on 13.01.2025, while the respondent police were on their routine patrol duty, they found that the petitioner and other accused were involved in illegal transportation of 5 bags of river sand (each containing 25 kgs.) in a two wheeler without any valid permit. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 25.09.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that there are totally two accused involved in this case and the petitioner is arrayed as A2; that the petitioner has 16 previous cases of similar nature and he is a history sheeter; and that the investigation of the case is pending.

Considering the submissions made on both sides, facts of the case, the previous antecedents of the petitioner and that the investigation of this case is still pending, this Court is not inclined to grant bail to the petitioner.
