Served, no appearance Order (Order of the Court was made by R.Suresh Kumar J.) This Civil Miscellaneous Petition is filed to condone the delay of 700 days in filing the writ appeal.

2. Heard Mr.R.Neethiperumal, learned Government Advocate appearing for the petitioner / State.

3. Sole respondent, though served and his name and address printed in the cause list, none has entered appearance.

4. Though some reasons have been stated, since the delay has already crossed 500 days such a huge delay cannot be condoned as a matter of course. Therefore, we are inclined to condone the delay on payment of a sum of Rs.3000/- (Rupees ThreeThousand Only) by the petitioner / State to the Tamil Nadu State Legal Services Authority towards its Environmental Fund , within a period of two weeks from the date of receipt of a copy of this order. On such payment, this petition is ordered.

5. Registry, on verification of the payment by the petitioner, shall number the appeal if it is otherwise in order and post for admission. The CMP is allowed on the above terms.
