ORDER
This Criminal Original Petition has been filed seeking a direction to the respondent to register the first information report based on the complaint of the petitioner dated 11.08.2025 and to take action in accordance with law.

The case of the prosecution is that the accused induced the petitioner to entrust the car bearing Registration No.TN 04 AX 2161 to him on the assurance of paying monthly rentals. However, the accused neither paid the agreed monthly rentals nor returned the vehicle. When the petitioner made efforts to trace the vehicle, the same could not be located. Thereafter, the petitioner lodged a complaint before the respondent on 11.08.2023. However, despite the commission of cognizable offences being disclosed against the accused, the respondent police failed to register a case. Aggrieved by the inaction of the respondent police, the petitioner has approached this Court by filing the present petition.

The learned counsel for the petitioner submitted that the accused, by practising deception, induced the petitioner to entrust the vehicle to him on the assurance of paying monthly rentals; however, the accused defaulted in payment of rentals and unlawfully sold the vehicle to a third party, pursuant to which, the petitioner lodged a complaint before the respondent on 11.08.2023. Despite the disclosure of cognizable offences, the respondent police failed to register the first information report. Hence, the present petition has been field seeking a direction to the respondent police to register the first information report and proceed in accordance with law.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the accused, by similar modus operandi, has cheated several other persons. On a complaint lodged by one Kirubakaran alleging that
he was also cheated in a similar manner, a case in Crime No.35 of 2026 has been registered against the accused. He further submitted that the respondent police are proceeding with the investigation and that the petitioner has been summoned for enquiry and his statement has been recorded. He also submitted that the said Kirubakaran has also spoken about the manner in which the petitioner has also been cheated and the case is being registered and the petitioner will be arrayed as a victim/witness. 5.
