Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records of impugned order of Vide proceedings Na.Ka.No.1854/2024/A5.Vu.E(Vuu), issued by the first respondent dated 10.12.2024 and quash the same as arbitrary, illegal, ultravirus and without jurisdiction and to direct first respondent to furnish the copies of the complaint and report in Na.Ka.No.3281/2024/A6 dated 30.10.2024 on the file of the third respondent.

ORDER

The petitioner came forward with a grievance that the proceeding initiated under Section 203 of the Panchayat Act are being proceeded further without furnishing a copy of the report of the Assistant Director of Panchayat. Since the petitioner pleaded that the records on the basis of which the District Collector has initiated proceedings are essential, I gave a direction to Mr.L.S.M.Hasan Fizal to produce the report of the Assistant Director, together with all the available records, and posted the matter today. 2/5

2. When I took up the matter today, Mr.L.S.M.Hasan Fizal has produced the report of the Assistant Director of Panchayat, as well as the report of the Tahsildar, and all the annexures relied upon by the District Collector. Mr.R.Naresh Kumar, appearing for the petitioner, acknowledges the receipt of the documents.

4. Furthermore, Mr.L.S.M.Hasan Fizal states that on the basis of the report filed by the Tahsildar, Thirukazhukundram, a further show cause notice was issued by the District Collector on 22.11.2025. 7 day's time has been granted by the Collector.

5. Considering the voluminous records that have been handed over today, it would not be possible for the petitioner to give a response immediately. Hence, time is extended till 11.12.2025 for the petitioner to give a response. On receipt of the response, if any, the District Collector shall pass orders by 30.12.2025.
