ORDER

This writ petition has been filed challenging the order passed by the third respondent on 09.09.2025.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner was working as a Supervisor in a TASMAC shop. While being so, an inspection was conducted on 23.08.2025, during which it was found that the liquor bottles were sold out at an excess price of Rs.10/- per bottle. Therefore, the petitioner and the salesman were issued with show cause notices and were subsequently suspended from service.

4. The learned counsel for the petitioner would submit that on the date of inspection, the petitioner had worked only upto 04.00 p.m. On

30.07.2025, while he was going outside, he met with an accident and sustained a fracture. He was undergoing continuous treatment. At that juncture, on 23.08.2025 an inspection was conducted and a show cause notice was issued to the petitioner. Therefore, the petitioner is in no way connected with the said allegations.

5. A perusal of records reveals that admittedly, the petitioner had worked till the evening on 23.08.2025. Without any permission, he went out of the shop as he was suffering from unbearable pain in his leg. Therefore, he had worked in the shop from the morning. That apart, he also failed to supervise the salesman, since he went out of the shop without permission.

In view of the above, the petitioner was rightly suspended from service and this Court finds no infirmity or illegality in the order passed by the third respondent on 09.09.2025 and the writ petition is devoid of merits and is liable to be dismissed. However, the third respondent is directed to conduct enquiry and complete the disciplinary proceedings, within a period of eight weeks from the date of receipt of a copy of this order.
