ORDER

This writ petition has been filed for direction directing the respondent to pay him a sum of Rs.69,909/- towards difference in

Gratuity and to pay him a sum of Rs.23,930/- towards difference in earned leave salary, with interest at the rate of 12 percentage per annum within a specified time as may be fixed by this Hon'ble Court.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner had joined in the service of the respondent Corporation as a Conductor on 07.04.1997. He served in various posts of respondent Corporation and retired on 31.05.2022. Based on his salary, he was settled with terminal benefits. However, 12(3) wage settlement was arrived on 24.08.2022 and the revised wage was given effect from 01.09.2019. Insofar as the monetary benefits is concerned, it was given effect from 01.01.2022. Accordingly, the petitioner's salary was revised and his pension was also revised in the month of March, 2023. However, the difference in earned leave salary and difference in gratuity were not settled so far. Hence, the petitioner submitted representation for disbursal of the said allowances.

In view of the above, the respondents are directed to revise the wages of the petitioner with effect from 01.09.2019 in terms of the 12(3) Wage Settlement dated 24.08.2022 and to disburse the differential amount towards gratuity and earned leave salary, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
