ORDER

This writ petition has been filed for direction directing the respondent to pay petitioner a sum of Rs.96,454/- towards difference in Gratuity and to pay him a sum of Rs.2,13,621/- towards 93 days of surrendered leave salary, which was surrender by the petitioner husband during his service and to pay the petitioner the IRT and PRBS amounts for the petitioner husband, with interest at the rate of 12 percentage per annum within a specified time as may be fixed by this Hon'ble Court.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner's husband had joined in the service of the respondent Corporation as a Driver on 28.08.1995. Her husband died on 21.06.2022. Based on the salary of the petitioner's husband, the petitioner was settled with terminal benefits of her husband. However, 12(3) wage settlement was arrived on 24.08.2022 and the revised wage was given effect from 01.09.2019. Insofar as the monetary benefits is concerned, it was given effect from 01.01.2022. Accordingly, the petitioner's husband's

salary was revised and his pension was also revised in the month of May, 2023. However, the difference in earned leave salary and difference in gratuity were not settled so far. Hence, the petitioner submitted representation for disbursal of the said allowances.

In view of the above, the respondents are directed to revise the wages of the petitioner's husband with effect from 01.09.2019 in terms of the 12(3) Wage Settlement dated 24.08.2022 and to disburse the differential amount towards gratuity and earned leave salary and also pay the petitioner the IRT and PRBS amounts for her husband, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
