Mr.R.Murthi Government Advocate for R1, R2 and R4 Mr.Abdul Mubeen for R3 C O M M O N O R D E R The petitioners are the President, Mutavali and a member of mosque/Wakf in the name of Masjid-E-Azam functioning at Vaniyambadi in Tiruppathur District, challenging the proceedings dated 14.08.2025 appointing the Adhoc interim committee consisting of 11 members to manage the affairs of Wakf and the consequential proceedings dated 18.10.2025 and proceedings dated 10.03.2026 directing the petitioners to hand over the charge of their office to the interim committee.
2. The petitioners claimed that the aforesaid Mosque is classified as Wakf and accordingly, the Committee was selected and appointed by Jamath members for a period of three years based on Wakf Deed. Accordingly, the petitioner and other members consisting of 11 in total were appointed on 08.10.2023 for three years upto 07.10.2026. However, based on the complaint lodged by one of the Jamath members/third respondent herein against the petitioner and committee members, the first respondent appointed Interim Committee consisting of new 11 members. Challenging the same, the present
writ petitions have been filed and the consequential proceedings dated 10.03.2026 directing the petitioners to hand over the charges to the New Committee is also assailed in the present writ petitions.
3. Heard the learned counsel appearing on either side and perused the materials available on record.
4. Admittedly, it is brought to the notice of this Court that already a writ petition has been filed in W.P.No.44521 of 2025 by the present Managing Committee challenging the interim committee order passed by the first respondent which is pending. The issues raised in the present writ petitions ought to be raised before the competent Civil Court/Wakf Tribunal and this Court under Article 226 of the Constitution of India cannot issue any directions to the Wakf Board which is the Competent Authority to decide the issues raised in this regard.
5. Accordingly, these Writ Petitions are dismissed. There shall be no order as to costs. Connected miscellaneous petitions are closed. 15-04-2026 Index: Yes/No Speaking/Non-speaking order ssb
