2. Being satisfied with the reasons stated in the affidavit filed in support of this petition and upon hearing the learned counsel appearing for the petitioner, we are inclined to condone the said delay.

3. Accordingly, the delay of 120 days is condoned and the Civil Miscellaneous Petition is ordered.

4. The Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and list it 'for admission'.
