O R D E R
The Civil Revision Petition is filed seeking a direction to the Principal Subordinate Court, Coimbatore to number the plaint in O.S.SR.No.3060 of 2025, dated 28.10.2025.
2. The petitioner herein filed a suit for cancelling the Settlement Deed dated 05.03.2003 executed by her in favour of petitioner's parent namely defendants 1 and 2. The plaintiff also sought for further declaration that the 1/4
Settlement Deed dated 10.11.2004 executed by the defendants 1 and 2 was null and void and not binding on the plaintiff. She also sought for permanent injunction restraining the defendants from interfering with her peaceful possession and enjoyment of the suit property.
3. The said plaint was returned by the Trial Court raising an objection with regard to the maintainability of the first prayer as similar suit filed by the petitioner on same cause of action was dismissed. The Trial Court also raised objection with regard to the second prayer.
4. The petitioner represented the plaint by offering her explanation. Again the plaint was returned by the Trial Court on the ground that the earlier return still holds good.
5. If the Trial Court is not satisfied with the explanation offered by the plaintiff, then the matter shall be called in open Court and the plaintiff shall be given an opportunity and order shall be passed on merits. In the case on hand, the Trial Court again returned the plaint stating that the earlier return still holds good.

6. When the plaintiff offered her explanation, no purpose will be served by returning the plaint again and again. Therefore, the petitioner is directed to represent the papers by offering her explanation/additional explanation, if any within a period of two weeks from the date of receipt of copy of this order. If the Trial Court is not satisfied with the explanation offered by the plaintiff, then the matter shall be called in open Court and final order shall be passed on merits, after hearing the petitioner.
7. With the above direction, the Civil Revision Petition is disposed of. No costs.
