PRAYER This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus directing the 2nd and 3rd respondents to grant victim compensation amount as per the Tamil Nadu Victim Compensation Scheme benefit of G.O. Ms. No.1055 dated 30.11.2013 by considering the application of the petitioner dated 09.10.2025 within a time frame as fixed by this Hon'ble Court.

ORDER

This writ petition is filed to direct the respondents 2 and 3 to grant victim compensation amount as per the Tamil Nadu Victim Compensation Scheme benefit of G.O. Ms. No.1055 dated 30.11.2013 by considering the application of the petitioner dated 09.10.2025 within a time frame as fixed by this Court. 2.The case of the petitioner is that the petitioner is a senior citizen and that on 24.06.2010, while the petitioner was in her house, some unknown accused came to the petitioner's house at 3.00 a.m. in the morning and threatened the petitioner and snatched away 7 sovereign of gold chain from the petitioner. In this regard, the petitioner made a complaint before the fifth respondent and fifth respondent filed a case in Crime No.315 of 2010 under Section 380 of IPC. After a lapse of a decade, the fifth respondent has now filed

a final report before the Jurisdictional Court as if the stolen jewels were not traceable. Therefore, the petitioner made an application before the second and third respondent on 09.10.2025 seeking for compensation in terms of G.O. Ms. No.1055 dated 30.11.2013 and the order passed by this Court in Crl.O.P.No.22051 of 2025, wherein, this Court has held that in cases involving senior citizens aged above 60 years, where they loose valuables such as money, jewels or other articles by way of theft and if the cases remain unsolved or untraceable, a minimum of 30% of their loss value or Rs.5,00,000/-, whichever is lesser should be given as compensation to the victims, in terms of Section 357 A of the Code of Criminal Procedure. In order to avail such a benefit, the petitioner made a representation dated 09.10.2025 before the second and third respondent. However, no order has been passed by the respondents 2 and 3 till date. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents 2 and 3 to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Advocate appearing for the respondents 1 to 3 and 6 submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondents 2 and 3 to consider and pass orders on the petitioner's representation dated 09.10.2025, in terms of G.O.Ms.No.1055 dated 30.11.2013 and the order passed by this Court in Crl.O.P.No.22051 of 2025 dated 03.09.2025, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
