PRAYER: Writ Petition (Criminal) is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus or direction in the nature of writ, to direct respondents 1 to 3 not to harass the petitioner in the name of any enquiry based on the false and frivolous complaint preferred by respondents 5 to 7 and further, restrain the 3rd and 4th respondents in any manner interfering with the petitioner's lawful business activities and day to day affairs of the partnership firm situated in the petition schedule property, except in accordance with due process of law. O R D E R

The present Writ Petition (Criminal) has been filed seeking a direction to respondents 1 to 3 not to harass the petitioner under the guise of enquiry and not to interfere with the petitioner's lawful business. The case of the petitioner is that under the pretext of conducting an enquiry in connection with the false complaint lodged by respondents 5 to 7, the respondent Police are unnecessarily harassing her. He further submitted that the civil suits are also pending between the parties.

Learned Additional Public Prosecutor, on instructions, submitted that based on the complaint given by respondents 5 to 7, the third respondent, the Assistant Commissioner of Police, Selayur Range, is conducting an enquiry and that the petitioner was called only for enquiry and was not harassed during the enquiry.

Recording the submissions made by the learned Additional Public Prosecutor, this Court directs the Investigating Officer to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and cooperate in the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry and that the enquiry shall proceed in accordance with law.

Accordingly, the Writ Petition (Criminal) stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 27.11.2025 ham 3/5
