Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Certiorarified Mandamus calling for the records relating to the proceedings in RC. No.31235/A3/ S2/ 2020 dated 14.08.2020 on the file of the 2nd respondent herein, quash the same and consequently direct the 2nd respondent to reinstate the petitioner in service forthwith in the light of the decision of the Honorable Supreme court in State of Tamil Nadu Vs. Promod Kumar, IPS in Civil appeal nos. 8427 and 8428 of 2018.dated 21.08.2018 within a time, limit to be specified by this 1/4

O R D E R
This Writ Petition has been filed challenging the order of suspension passed by the 2nd respondent dated 14.08.2020, thereby the petitioner was suspended from service.
2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.The only ground raised to challenge the order of suspension is that the petitioner has been under prolonged suspension for the past five years. However, till date, no charge memo has been issued to the petitioner. That apart, a criminal case is also pending against the petitioner without any progress. Therefore, the petitioner submitted a representation seeking revocation of the suspension order in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022. However, the same was rejected by the 2nd respondent without taking into account the instructions and guidelines stipulated in the aforesaid Government Order.
4. In view of the above, the 2nd respondent is directed to consider 2/4
the case of the petitioner in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, and pass appropriate orders on merit and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected Miscellaneous Petition is closed.
