ORDER

The petitioner, who was arrested and remanded to judicial custody on 21.09.2025, for the alleged offence punishable under Sections 103(1) of BNS altered to section 103(1) and 238 of BNS in Crime No.306 of 2025, on the file of the respondent police, seeks bail.

The allegation against the petitioner is that, the petitioner is ranked as A2 in this case and while this petitioner consuming liquor with other accused, the deceased also joined with them and there was a quarrel taken place between them. Hence this petitioner and other accused, attacked him and also stabbed him by using knife. Thereafter, they also tied his body and dumped in the nearby pond. Hence, the complaint was registered.

3. The learned counsel for the petitioner submitted that, the petitioner is in custody from 21.09.2025 and the major part of the investigation concluded and there are no eye witness to the occurrence. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) reported that there are witnesses connecting the accused with the occurrence and he further submitted that both the accused were arrested and the investigation is not concluded. He further submitted that there are no bad antecedents against the petitioner. Hence, he opposed for grant of bail to the petitioner.

5. I have considered the submissions made on both sides and perused the records. The facts revealed that it is not only a case of murder but it is also screening of offence. The petitioner has stabbed the deceased and after his death, the petitioner tied his body with stone and dumped the dead body in the nearby pond. Hence, I am not inclined to grant bail to the petitioner at this stage.
