Writ Petition (Criminal) filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 1st and 3rd respondents to act under the law with the police protection and 2nd respondent for survey the land.

ORDER
Though the prayer is not satisfactorily worded, this Court understands that the petitioner needs police protection to the 2nd respondent (Tahsildar) to survey his land.
2. Mr.S.Santhosh, learned Government Advocate (Crl. Side) takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.

Learned counsel for the petitioner submitted that the petitioner is the absolute owner of the property comprised in S.Nos.300 and 300/3 measuring an extent of 6 acres, situated at Marthyan Thottam, Ganapathi Palayam, Mangalam, Tiruppur District. However, as there is interference by the neighbouring land owners, the petitioner sent a representation/letter dated 27.10.2025 to the respondents seeking to verify and survey his land so that he can put up a compound wall. However, till date, no action has been taken by the respondents on the said representation. Accordingly, he prayed for appropriate orders of this court directing the 2nd respondent to survey the
subject land with police protection to be provided by the 1st and 3rd respondents.
4. Learned Government Advocate (Crl. Side) appearing for the respondents submitted that the competent authority to consider the petitioner's claim is the Taluk Surveyor. If any application is made by the petitioner before the jurisdictional Taluk Surveyor and if any request is made by the Taluk Surveyor, appropriate protection will be provided by the respondent police.
5. In view of the above submission made by the learned Government Advocate (Crl. Side), this Court directs the petitioner to make a representation to the 2nd respondent as well as the jurisdictional Taluk Surveyor along with a copy of this order, seeking survey of his land. Upon receipt of such application, after fixing of a specific date and after putting all the interested parties on notice, if any police protection is sought either by the 2nd respondent or the jurisdictional Taluk Surveyor, necessary protection shall be given by the respondent police for surveying the subject land, as submitted by the learned Government Advocate (Crl. Side).
6. With the above directions, this writ petition (criminal) stands disposed of. No costs.
