Respondents PRAYER : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents 1 to 4 to evict the encroachment made in Survey Nos.109 EXT AC 5.50 cents and 110 EXT AC 18.28 cents in Kundumaranapalli Village, Denkanikottai Taluk, Krishnagiri District as per due process of law within a stipulated time that may be fixed by this Honourable Court. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Heard.
2. In view of the statement made by learned State counsel that during the pendency of the petition, after survey, notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 (the Act) was issued to respondent Nos.5 to 8, followed by order passed under Section 6 of the Act, we are not inclined to proceed further in this matter.
3. We leave it open for respondent Nos.5 to 8 to take appropriate remedy, as may be available under law, in case they are aggrieved by the order passed under Section 6 of the Act.
4. The petition is, accordingly, disposed of. There shall be no order as to costs.
