The petitioners, who were arrested and remanded to judicial custody on 29.09.2025 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B), and 25, 29(1) of NDPS Act, in Crime No.508 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against these petitioners is that, these petitioners were jointly found in possession of 1.600 kgs of ganja. Hence they were arrested and remanded. Hence this case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and the petitioners are in judicial custody since 29.09.2025 and that the petitioners are ready to abide by any stringent conditions. He further submitted that the petitioners are in custody and property seized and contraband is also falls within the intermediary quantity, hence Section 37 of NDPS Act is not applicable. Hence, he prays to grant bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that these petitioners 2/5

are habitual offenders and Kingsly Paul @ Paul / A1 is having 8 previous cases including under Section 302 and 307 of IPC, Devendiran @ Deva / A2 is having 4 previous cases out of which two cases under Section 302 IPC and Dinesh Kumar / A3 is having 8 previous cases which including 307 IPC and opposed for grant of bail to the petitioners.

Considering the fact that the petitioners are having bad antecedents and Kingsly Paul @ Paul / A1 is having 8 previous cases including under Section 302 and 307 of IPC, Devendiran @ Deva / A2 is having 4 previous cases out of which two cases under Section 302 IPC and Dinesh Kumar / A3 is having 8 previous cases which including 307 IPC, this Court is not inclined to grant bail to the petitioners at this stage.
