Writ petition filed under Article 226 of Constitution of India for issuance of WRIT OF MANDAMUS directing the respondents to consider petitioner representation dated 21.06.2025 and release petitioner husband namely M.Pandiyan son of Mani, Life Convict, Convict No.2416 now confined in the Central Prison-I, Puzhal, Chennai under the 20 years premature release police Scheme and thus render justice.

ORDER

(Order of the Court was made by Dr.Anita Sumanth J.) This Writ Petition is instituted by the wife, one M.Pandiyan, son of Mani, who is a life convict (No.2416), confined in Central Prison I, Puzhal, Chennai. She seeks a mandamus directing the respondents to consider the representation filed by her on 21.06.2025 for premature release of her husband under the 20 year premature release policy scheme under Letter FS.No.1358 Home dated 10.11.1994.

2. Under the aforesaid scheme, the State considers release of life convicts who have undergone 20 years of actual imprisonment on humanitarian grounds, based on various parameters set out thereunder.

3. Mr.Muniyapparaj, learned Additional Public Prosecutor assisted by Mr.Sylvester John, learned counsel, who accepts notice for the respondents is armed with necessary instructions to enable a final disposal of the matter, even at the stage of admission.

4. He would submit that representation dated 21.06.2025 has been received by all the respondents and that the same is under consideration. On instructions, he undertakes that the representation would be disposed in accordance with law, ensuring compliance with the ingredients of letter dated 10.11.1994, and applicable government orders, within a period of twelve (12) weeks from today.
