ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.10.2025, for the alleged offence punishable under Sections 8(c) r/w 23, 28, 29 of the NDPS Act, in Crime No.183 of 2025, on the file of the Judicial Magistrate Court, Alandur, seeks bail.

The allegation against this petitioner is that, on 08.10.2025 at approximately 00.30 hours, Shri Yumkhaibam Jeevan Singh, arriving on Thai Airways Flight TG 337 from Bangkok to Chennai on 07.10.2025, was intercepted at the Arrival Hall exit of Anna International Airport, Chennai. His checked-in baggage, a green trolley suitcase without markings, was examined. Inside, twelve vacuum-sealed black plastic bags containing green flowering / fruiting tops suspected to be Ganja / Marijuana were found. The total gross weight of the seized substance was 8.475 grams, with a net weight of 7,473 grams after subtracting packaging. Hence the petitioner was arrested.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. 2/6
He would further submit that the petitioner was arrested and he is in judicial custody from 08.10.2025 and is ready to abide by any conditions that may be imposed by this Court. He further submitted that investigation already concluded, the petitioner is not having any bad antecedents and he has already give a voluntary statement. Hence, he prayed for grant of bail to the petitioner.

Learned counsel appearing for the respondent submitted that the trafficking of the ganja is taken place regularly between Thailand and India through Chennai and they suspect that the involvement of the officers who are working in the Chennai International Airport and without the involvement of the officers that could not be easily exit of the contraband. Further the investigation regarding the person who is take delivery from the Chennai Airport is also under process and the petitioner herein has also not able to inform the name of the recipient of the contraband. The contraband was brought from Bangkok with instructions that the recipient will contact the petitioner herein once he reached the Airport. Similarly the person who sent the contraband is alleged to have been hailing from Manipur and locating him is also underway. He further submitted that since it is an International trafficking, various other aspects are also to be investigated and the investigation in this line is also pending. Hence, he opposed for grant of bail to the petitioner. 3/6

I have considered the submissions made on both sides, perused the records and it is demonstrated before me that it is a well orchestreted smuggling activity and though it is stated that it is the case of intermediary quantity, various aspects of investigation regarding this network is pending, hence if the bail is granted to the petitioner there is likelihood of hampering the investigation, and this Court is not inclined to grant bail to the petitioner.
