O R D E R

The petitioner seeks a direction to the 1st respondent to process the petitioner's Passport Application No.MA1064185600522 and issue the passport based on the documents submitted without insisting upon the father's birth certificate within a time frame as may be fixed by this Court. 2.According to the petitioner, he filed a Passport Application bearing No.MA1064185600522 on 06.03.2022 before the Regional Passport Office, Chennai. However, without processing the same, the 1st respondent has doubted the nationality of the father of the petitioner. Despite production of several documents in support of his claim, the petitioner's application has not been considered. Hence, the petitioner has come forward with this writ petition.

3.A counter affidavit has been filed by the 1st respondent. According to the 1st respondent, in the Police verification, they came to know that the petitioner is a Nepal citizen and a show cause notice was issued to the petitioner. Pursuant thereto, on 30.05.2022, the petitioner produced certain service documents of his father, however, the same did not reveal his domicile and place of birth. Again, on 15.07.2024, the petitioner produced the Birth Certificate of his mother. According to the respondents, after verifying the genuineness of the petitioner's mother's Birth Certificate, if the same is found to be genuine, they will issue passport to the petitioner. Since the petitioner claims that he was born in Chennai, if any one of his parents was an Indian citizen at the time of birth, the petitioner is also a citizen of India and they will process the application after verifying the Birth Certificate.

4.In such view of the matter, let the 1st respondent process the petitioner's application and a decision shall be taken within a period of one month from the date of receipt of a copy of this order and in the meanwhile, the petitioner can also produce all the service records of his father, before the 1st respondent.

5.With the above directions, this writ petition is disposed of. No costs.
