ORDER

This petition has been filed, seeking to relax the condition in Crl MP.No.14954 of 2024 in Crl OP.No.3649 of 2024 by order dated 30.10.2024,

directing the petitioner to appear before the learned Chief Judicial Magistrate, Thiruvallur, once in three months, commencing from November 2024. 2.The petitioner/accused in Crime no.3 of 2023 was arrested and later granted bail by the trial Court on 24.03.2023. Thereafter, a cancellation of bail petition was filed by the respondent and the same was allowed. Against which, the petitioner had filed a petition before this Court in Crl.OP No.3649 of 2024 and this Court was pleased to allow the petition by order dated 07.06.2024 and at that time, directed the petitioner to appear before the Chief Judicial Magistrate, once in a week, till filing of the final report. Thereafter, a petition in Crl.M.P.No.14954 of 2024 was filed seeking for modification and this Court by order dated 30.10.

2024, modified the condition, directed the petitioner to appear before the respondent once in three months commencing from November 2024 and he has been complying the same till today. 3.The learned Government Advocate(Crl.side) appearing for the respondent would submit that in this case, the petitioner after coming out on bail, attempted to tamper with the witnesses and a cancellation of bail petition was filed and the same was allowed.

before the respondent initially daily and thereafter, once in 3 months before the Chief Judicial Magistrate, Thiruvallur. He further submitted that in this case investigation has been completed and charge sheet has also been filed in Crime no.7 of 2025.

4.Now pursuant to the ROC passed by this Court, during May 2025, transferring the case under Prevention of Corruption Act to the Court of PDJ, and the case is not in progress and steps were taken to transfer the case to PDJ. 5.The learned counsel for the petitioner submitted that as and when the petitioner is directed to appear before the Sessions Court, he would appear before the concerned Court without delay.

In view of the above, this Court finds that the investigation was already completed and a charge sheet was also filed and the petitioner has been regularly complying the condition, further the case is likely to be transferred to the Sessions Court, the condition imposed on the petitioner to appear before the trial Court once in three months, till the disposal of the appeal, is totally relaxed. All other conditions remain unaltered.
