ORDER

This writ petition has been filed for a mandamus seeking for a direction to the first respondent to consider the petitioner's representation dated 04.05.2023 requesting for issuance of patta in his favour for the property morefully described in the affidavit filed in support of this writ petition.

2. The petitioner claims that he has been in possession of the subject property for a long number of years, pursuant to an assignment order of the year 1979. Eventhough the petitioner has disclosed that the said assignment order has been cancelled subsequently, the petitioner still claims that he is entitled for patta as he has been in uninterrupted possession of the subject property despite cancellation of assignment order.

3. Till date, the respondents have not filed their counter affidavit.

4. The learned Special Government Pleader appearing for the respondents would submit that since the assignment order has been cancelled, the request of the petitioner seeking for issuance of patta cannot be entertained by the second respondent.

5. Since the respondents have not filed their counter affidavit till date, this Court is of the view that no prejudice will be caused to them if a direction is issued to them to consider the petitioner's representation dated 04.05.2023 on merits and in accordance with law, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the second respondent to pass final orders on merits and in accordance with law, on the petitioner's representation dated 04.05.2023 seeking for issuance of patta in his favour for the property morefully described in the affidavit filed in support of __________Page 3 of 5

this writ petition, after giving due consideration to the contents of the representation of the petitioner with supporting documents. The second respondent is directed to complete the aforesaid exercise within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the petitioner's representation dated 04.05.2023.
