O R D E R

This Criminal Original Petition has been filed by the petitioner/de facto complainant to direct the learned Judicial Magistrate-VII, Puducherry, to dispose of the case in S.T.C.No.3358 of 2024 expeditiously, preferably within a period of three months.

2. The learned counsel for the petitioner/de facto complainant would submit that the case in Crime No.5 of 2021 was registered by the respondent police against the accused, for the offences under Sections 294(b), 323, 506(i) read with Section 34 of IPC on 13.01.2021 and the final report was filed on 29.11.2022. However, the same was taken up for trial only in the year 2024 in S.T.C.No.3358 of 2024 on the file of the Judicial Magistrate-VII, Puducherry. He would further submit that there is no progress in the trial. Hence, the present petition has been filed seeking a direction for speedy disposal of the case in S.T.C.No.3358 of 2024.

3. The learned Public Prosecutor (Puducherry) appearing for the respondent police would submit there are totally six witnesses in this case. The petitioner is L.W.1 in this case. However, she is refusing to accept the 2/6

summons. He would further submit that now, the case now stands posted to 01.12.2025.

4. Heard and perused the materials available on record.

5. The petitioner who is L.W.1 and who is not co-operating even to receive summons, cannot seek early disposal of the case. Be that as it may, now, the case stands posted to 01.12.2025.

6. Therefore, the learned Judicial Magistrate-VII, Puducherry, is directed to dispose of the case in S.T.C.No.3358 of 2024, as expeditiously as possible preferably within a period of six months from 01.12.2025. The petitioner shall co-operate for speedy disposal of the case.

7. With the above directions, this Criminal Original Petition is disposed of.
