ORDER

This writ petition has been filed, seeking for a direction to the respondents to forthwith release the lands morefully described in the prayer to this writ petition from the purview of Tamil Nadu Bhoodan Act, 1958 based on the petitioners' representation dated 04.08.2025.

2. The learned counsel for the petitioners would now submit, on instructions, that it would be suffice if a direction is issued to the competent authority to consider the petitioners' representation, seeking for release of the lands morefully described in the prayer to this writ petition from the purview of Tamil Nadu Bhoodan Act, 1958 to dispose of the petitioners' representation within a time frame to be fixed by this Court after giving due consideration to the documents produced by the petitioners along with this writ petition.

It is now brought to the notice of this Court by the learned Government Advocate appearing for the respondents that the competent authority to adjudicate the petitioners' representation is the District Collector viz., the second respondent herein. Since the earlier representation was given by the

petitioners to the fourth respondent, who is not a competent authority, the petitioners will have to give a fresh representation to the competent authority viz., the second respondent herein.

4. The learned counsel for the petitioners, on instructions, would submit that the petitioners are willing to submit a fresh representation to the second respondent. The said statement is recorded.

5. No prejudice would be caused to the respondents if the petitioners are directed to submit a fresh representation to the second respondent, seeking for release of the lands morefully described in the prayer to this writ petition from the purview of the Tamil Nadu Bhoodan Act, 1958 within a time frame to be fixed by this Court and a direction is issued to the second respondent to pass final orders on merits and in accordance with law on the petitioners' representation after giving due consideration to the documents produced by the petitioners along with the representation within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioners' representation.

7. For the foregoing reasons, this Court directs the petitioners to submit a

fresh representation to the second respondent, seeking for release of the lands morefully described in the prayer to this writ petition from the purview of the Tamil Nadu Bhoodan Act, 1958 within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time, the second respondent shall pass final orders on merits and in accordance with law after giving due consideration to the supporting documents filed by the petitioners within a period of twelve weeks thereafter.

8. Accordingly, this writ petition is disposed of. No Costs. Consequently, W.M.P. No.50060 of 2025 is ordered, subject to payment of separate Court fee and W.M.P. No.50064 of 2025 is closed.
