ORDER

This criminal original petition has been filed to modify the condition to deposit a sum of Rs.7,21,550/- (Rupees Seven Lakh Twenty One Thousand Five Hundred and Fifty only) before the learned Judicial Magistrate No.I, Arakkonam by the petitioner herein by an order dated 11.11.2025 in Crl.M.P.No.1590 of 2025 passed by the learned Principal Sessions Judge, Ranipet.

The learned counsel appearing for the petitioner submitted that, the petitioner herein was granted bail by the Principal Sessions Judge, Ranipet, vide order dated 11.11.2025 in Crl.M.P.No.1590 of 2025 for the offence under Sections 296(b), 316(2), 318(2), 318(4) and 351(2) of BNS in Crime No.639 of 2025 on the file of the respondent police with one of the conditions that, the petitioner shall deposit a sum of Rs.7,21,550/- before the learned Judicial Magistrate No.I, Arakkonam at the time of execution of sureties; that the petitioner and his family members are daily wages and hence the petitioner is unable to mobilize the aforesaid amount; that inspite of granted bail on 11.11.2025, the petitioner is still languishing in jail due to the aforesaid condition, hence prays to modify the aforesaid condition. 2/4

Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

Considering the submissions made on both sides, the nature of offence, the period of incarceration undergone by the petitioner and taking note of the fact that, though the petitioner has been granted bail on 11.11.2025, he is still languishing in jail, this Court is inclined to modify the deposit amount imposed on the petitioner herein by the learned Principal Sessions Judge, Ranipet, vide order dated 11.11.2025 in Crl.M.P.No.1590 of 2025 as "Rs.3,50,000/-" (Rupees Three Lakhs and Fifty Thousands only) instead of "Rs.7,21,550/-" and as far as the other conditions imposed on the petitioner herein, as per the aforesaid order remain unaltered. 5.
