O R D E R
The review application has been to review order dated 17.10.2025 in W.P. (Crl) No.1138 of 2025.
2. This Court while disposing of the above writ petition has passed the following order:
'2. According to the petitioners, the police are unnecessarily interfering with their possession. The private respondents have already filed a suit before the District Munsif Court, Ponneri in O.S.No.116 of 2025 seeking permanent injunction and that, no injunction has been granted in their favour. Now the matter has been adjourned to 27.10.2025. However, the respondents are interfering with their possession.
3. The learned Additional Public Prosecutor appearing for the respondents police, on instructions submitted that the police will not interfere with the possesion of any one unless there is law and order issue. The same is recorded. 3/7
4. It is made clear that as long as a dispute is in respect of a civil right, the police have no right to interfere except if any criminal offence is committed.
5. With the above observations, this Writ Petition is disposed of. Consequently, the connected miscellaneous petition is closed."
3. Mr.V.Raghavachari, learned Senior counsel submitted that this review application has been filed on the ground that the order has been obtained by suppressing material facts. According to learned Senior counsel 5th respondent herein resigned from the Company on 20.11.2023, the petitioner herein inducted in the company from 17.11.2023 and the Certificate of Sale was also issued on 24.11.2023 and all these facts have been suppressed and orders have been obtained.
4. This Court considered the submissions and also perused the materials placed before this Court.
5. This Court is of the view that the entire issue with regard to possession of the property has to be agitated before the competent civil Court. This Court has already passed an order stating that the suit in O.S.No. 116 of 2025 for permanent injunction is pending before the District Munsif Court, Ponneri. When that being so, the respective parties who 4/7
dispute their possession have to establish their right in a pending suit. This Court has passed the order in the writ petition based on the submission of the learned Additional Public Prosecutor that the police will not interfere with the civil dispute except if any criminal offence is committed. It has also been recorded in paragraph 4 of the impugned order that as long as a dispute in respect of a civil right is involved, the police have no right to interfere except if any criminal offence is committed.
6. It is made clear that as far as the civil rights of the parties are concerned, they will have to establish their right before the Civil Court where the suit is pending. It is also made clear that merely because the police undertook not to interfere with the dispute, the same will not give licence to any one to commit any act or trespass or dispossess and the rights of the parties have to be decided only in the civil Court. With the above direction, this review application is disposed of. Consequently, the connected miscellaneous petition is closed. 01.12.2025 gpa Index: Yes/No Internet: Yes 5/7
