ORDER

The petitioners/accused, who apprehend arrest for the alleged offence under Sections 303(2) of BNS, 2023 in Cr.No.447 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was indulged in illegal transportation of four units of normal stones by using Ashok Leyland tipper lorry. Hence, the case.

3. While considering the bail petition filed by the petitioner in Crl.OP.No.29045 of 2025 dated 27.10.2025, this Court after considering the various points, dismissed the petition. The relevant portion of the order passed by this Court in Crl.OP.No.29045 of 2025 is reads as follows: " Considering the facts and circumstances of the case, nature of allegations and the submissions made by learned counsel on either side, considering the fact that the petitioner has one previous case pending against him and the fact that the petitioner had allegedly in charged in illegal quarrying activities causing damage to the government land, this Court is not inclined to grant anticipatory bail to the petitioner ".

4. Subsequent to the dismissal of the above petition, the petitioner has filed the present petition on the very same grounds that were raised in the earlier bail petition. Further, there is no change in circumstances after the 2/4

dismissal of earlier petition. Hence, this Court is not inclined to reconsider once again the merits of the claim made in the earlier bail petition. 10.12.2025 Vv To
