ORDER
This writ petition has been filed, challenging the impugned notice dated 05.11.2025 issued by the first respondent. The impugned notice has been issued by the first respondent to the petitioner for the purpose of holding an enquiry on the representation given by the fourth respondent, seeking for cancellation of the petitioner's patta. The said enquiry is being conducted pursuant to the directions given by this Court on 06.02.2025 in W.P.No.33563 of 2022 filed by the fourth respondent.

Through the aforesaid order of this Court, the fourth respondent's representation, seeking for cancellation of petitioner's patta, was directed to be disposed of within a period of eight weeks from the date of receipt of a copy of the said order. The petitioner without participating in the said enquiry has challenged the summons issued to him for his appearance in this writ petition.
3. Necessarily, the petitioner will have to participate in the enquiry conducted by the first respondent pursuant to the directions given by this Court on 06.02.2025 in W.P.No.33563 of 2022. The contentions that have been raised before this Court can very well be raised by the petitioner before the first respondent by participating in the enquriy. Instead of following the said procedure, the petitioner has approached this Court by filing this writ petition,
which is not maintainable.

Any objection, which the petitioner has with regard to the request made by the fourth respondent for cancellation of petitioner's patta, the same will have to be raised by the petitioner only before the first respondent and not before this Court in a writ petition under Article 226 of the Constitution of India.
5. This Court is not expressing any opinion on the merits of the respective contentions made by the respective parties.
6. Since this writ petition is not maintainable in view of the fact that the petitioner has challenged the summons issued by the first respondent, pursuant to the directions issued by this Court on 06.02.2025 passed in W.P. No.33563 of 2022, this Court need not go into the merits of the objections raised by the petitioner in this writ petition with regard to the request made by the fourth respondent, seeking for cancellation of the petitioner's patta.

For the foregoing reasons, this writ petition is disposed of by directing the petitioner to participate in the enquiry conducted by the first respondent pursuant to the issuance of impugned notice, pursuant to the directions issued by this Court on 06.02.2025 in W.P. No.33563 of 2022 in the writ petition filed
by the fourth respondent. The first respondent shall consider all the objections raised by the petitioner as well as the objections raised by the fourth respondent and thereafter, pass a final order on merits and in accordance with law on the fourth respondent's representation, seeking for cancellation of petitioner's patta as directed by this Court on 06.02.2025 in W.P.No.33563 of 2022.
8. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
