ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the respondents and in particular, the 3rd respondent to consider the representation made by the petitioner on 08.08.2025 wherein the petitioner has sought for demarcation of the subject property and for identification of the property and for issuance of separate patta.

Heard Mr.K.Gangadaran, learned counsel for the petitioner and Mr.D.Racichander, learned Special Government
Pleader for respondents 1 to 4.

The case of the petitioner is that her grand father became the owner of the property by virtue of a partition deed dated 17.06.1978. Whatever share was given to the grand father was settled in favour of the petitioner's mother through Settlement deed dated 28.02.1996 vide Document No.185/1996. The revenue records was also mutated in the name of the mother and she was included as the 4th Pattadarar in the joint patta.

The petitioner's mother thereafter settled the property in favour of the petitioners through a settlement deed dated 29.07.2021 registered as document No.1975 of 2021 and an extent of 1.01 cents was settled in favour of the petitioner. The other portion of 0.81.00 cents was settled in favour of the petitioner's brother. Thereafter, Patta NO.1142 was issued by including the name of the petitioner and his brother.

The grievance of the petitioners is that one Vasantha had executed a Sale deed wherein the extent belonging to the petitioners was also included.

The petitioners in order to avoid any further confusion submitted an application on 23.07.2025 to the 3rd respondent and sought for the survey of the property and for issuance of individual patta. Since no action has been taken, the present writ petition came to be filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 3rd respondent to act upon the application submitted by the petitioners on 23.07.2025 and take a decision in accordance with law, after affording opportunity to the petitioners and the rival parties within a period of eight weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs.
