The petitioner who was arrested and remanded to judicial custody on 08.09.2025, seeks bail in S.C.No.250 of 2023 for the offence punishable under Sections 294(b), 341, 302, 506(ii) of IPC, in Crime No.437 of 2022, registered on the file of the respondent.

Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.250 of 2023 on the file of the learned V Additional Sessions Court, Chennai and subsequently, he had not appeared before the trial Court, and non-bailable warrant was issued on 10.01.2024 and the same was executed on 08.09.2025. He further submitted that the petitioner was not aware about the surety action and declaration made against him. He also submitted that the petitioner will undertake that hereafter he will regularly appear before the trial court on all hearing dates and also stated that he is prepared to comply with any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that in this case, petitioner continuously absconding and further, the surety actions were also taken, and it revealed that bogus sureties were executed now the case is posted for examination of LW3 and the trial is going on.

4. Heard both sides and perused the materials available on record. 2/4

5. Considering the facts and circumstances of the case and the fact that the trial is going on and already two witnesses were examined and also considering the conduct of the petitioner that he had executed bogus sureties, this Court is not inclined to grant bail to the petitioner.
