Alleging that proper investigation has not been conducted and that the relevant sections have not been included in the First Information 1/4
Report in Crime No.747 of 2024 by the respondent Police, the present Writ Petition (Criminal) has been filed.

When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that based on the complaint given by the petitioner, a case in Crime No.747 of 2024 was registered on 05.09.2024 for the offences under Sections 296(b) and 324(4) of the BNS, 2023, in respect of the occurrence that took place on 29.08.2024. Subsequently, during the course of investigation, based on the materials available, the case was altered to one under Sections 296(b), 324(4) and 49 of the BNS, 2023 and Section 4 of the TN Prohibition of Harassment of Women Act. He further submitted that the investigation in this case has been completed, the final report has been filed and the same has been taken cognizance of on the file of the Judicial Magistrate, Sriperumbudur, in C.C.No.340 of 2025 and the same stands posted on 05.01.2026 for commencement of trial.

In reply, the learned counsel appearing for the petitioner submitted that there are materials to show that the accused have also committed the offence under the TNPPDL Act 2/4

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record, this Court is of the considered view that since cognizance has been taken and the matter stands posted for commencement of trial, the petitioner shall proceed in accordance with law.

Accordingly, this Writ Petition (Criminal) stands disposed of. No costs.
