Tamil Nidhi for R2 COMMON ORDER These two Writ Petitions have been filed seeking a direction to the respondents to implement the order passed in W.P.No.24962 of 2009 dated 09.02.2024 by extending the benefits thereof to the petitioners, by refixing their salaries on par with the employees of the Sugar Mill and further, directing the 2nd respondent to pay all arrears of salary from the date of appointment within a time-bound manner.

2. Since the prayers and facts involved in both the writ petitions are identical, they are disposed of by way of a common order.

3.The case of the petitioners is that they are employed as Canteen Staff and Assistant respectively, under the 2nd respondent / Kallakurichi Cooperative Sugar Mill Ltd., having joined service in the years 1982 and 1983 respectively. Their pay scales were fixed pursuant to a settlement under Section 18(1) of the Industrial Disputes Act, 1947. Though subsequent settlements in 1995 and 1996 provided for pay revision, the same was not implemented. While, similarly placed canteen employees in other Government establishments were granted regular pay revisions, the petitioners' representations were rejected, leading to the filing of W.P No.24962 of 2009 which was allowed by this Court on 09.02.2024, directing revision of pay scales on par with Sugar Mill employees.

Pursuant thereto, the 2nd respondent revised the pay and paid arrears to all similarly placed employees, except the present petitioners. Consequently, the petitioners submitted a detailed representation dated 05.12.2025 seeking implementation of the said order in their favour. As no action has been taken till date, the present writ petition has been filed.

4. The learned counsel for the petitioners would submit that this Court may issue a direction to the 2nd respondent to consider the petitioners' representation dated 05.12.2025 in the light of the order passed by this Court in W.P No.24962 of 2009 dated 09.02.2024.

5.Considering the limited request made by the learned counsel for the petitioners and without expressing any opinion on the merits of the case, this Court, directs the and 2nd respondent to consider the petitioners' representation dated 05.12.2025, and to pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

6. With the above direction, these two writ petitions stand disposed of. No costs.
