ORDER

The petitioner, who apprehends arrest for the alleged offence punishable under Sections 21(1) of MM Act and Section 303(2) of BNS Act, in Crime No.414 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The allegation against this petitioner is that, this petitioner joining hands with other accused and illegally quarrying and transporting 2 1⁄2 units of river sand. Hence this case.

3. The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution, and he has been falsely implicated in this case. He further submitted that the coaccused already arrested and released on bail. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner illegally quarried the 2 1⁄2 units of river sand without valid permission, the petitioner is not having any previous case. Hence, he opposed to grant anticipatory bail to the petitioner. 2/4

Considering the facts and circumstances of this case, I have also gone through the previous order in Crl.O.P.No.30303 of 2025 the arrested accused in this case totally 2 1⁄2 units of river sand has been taken and I am of the view that though it is stated that co-accused released on bail, he was not having any previous case, and if the petitioner released on anticipatory bail there is likelihood and he will indulge in similar activities, and this Court is not inclined to grant anticipatory bail to the petitioner with certain conditions.
