ORDER
The petitioner, who apprehends arrest for the alleged offence punishable under Sections 326(a), 303(2) of BNS Act (Corresponding Section 379, 430 of IPC) and Section 21(1) of MM Act, in Crime No.687 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The allegation against this petitioner is that, this petitioner is ranked as A1 and illegally quarrying and transporting 4 units of Morambu sand. Hence this case.
3. The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution, and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner illegally quarried the 4 units of Morambu sand without valid permission, the petitioner is having two previous cases. Hence, he opposed to grant anticipatory bail to the petitioner. 2/4

Considering the facts and circumstances of this case, this petitioner is illegally quarried 4 units of Morambu sand and the petitioner is having two previous cases, if the anticipatory bail is granted to the petitioner he will indulge in similar activities, and this Court is not inclined to grant anticipatory bail to the petitioner with certain conditions.
