A.No.6074 of 2025 in C.S.No.76 of 2024 P.DHANABAL, This application has been filed by the applicant to condone the delay of 152 days in filing the written statement of the third defendant.

2. According to the applicant, he is the third defendant in the main suit. The respondents 1 & 2 have filed the suit for specific performance. The applicant has already filed the written statement on 28.10.2024 and the same was returned.

Thereafter, it was not re-presented by his previous counsel. Therefore, there is a delay of 152 days occurred in filing the written statement.

3. The other side have not filed any counter.

4. Considering the reasons stated in the affidavit filed in support of this petition and in order to give a fair chance to the applicant to defend the case, this application is allowed and the delay of 152 days is hereby condoned.
