ORDER
W.M.P.No. 50332 of 2025 has been filed to dispense with the production of the original impugned order passed by the first respondent. Hence, W.M.P.No. 50332 of 2025 stands ordered as prayed for.
2. The petitioner has challenges an order passed under Section 87 of the Tamil Nadu Co-operative Societies Act. The order so passed is susceptible to a challenge by way of an appeal before the Principal District Judge cum Cooperative Tribunal constituted for Ranipet District.
3. Ms. Dharani representing Mr.C.Prakasm states that the impugned order itself was not served on the petitioner. She invite my attention to paragraph No.7 of the affidavit to point out that the order dated 09.12.2022 was served on the petitioner only on 24.10.2025.
4. The petitioner can always state this before the learned Cooperative 2/4
Tribunal and get the appeal numbered. It would be open to the Cooperative Society to bring forthwith to the notice of the Cooperative Tribunal that the impugned order dated 09.12.2022 was served soon thereafter on the petitioner and it was the petitioner, who had not approached the Court in time.
5. The learned Principal District Judge shall frame an issue on whether the impugned order was served in time or not and answer the same. At the initial state, the learned Judge will take into consideration the plea made by the petitioner that the order copy was not served and shall number the appeal. When the appeal is taken up, the learned Judge is also requested to consider whether 18% interest imposed on the petitioner requires interference or not.

In so far as the proceeding dated 06.08.2025 demanding a sum of Rs.12,55,840.50, Mr.S.Ravikumar, appearing for the first respondent states that the said proceeding has been withdrawn and a fresh order has been passed on 19.11.2025 scaling down the liability to Rs.1,85,000/-. The service is recorded. V. LAKSHMINARAYANAN , J.

7. With the above liberty to file an appeal within 30 days from today, the Writ Petition stands dismissed. No costs. Consequently, W.M.No. 50333 of 2025 stands closed.
