Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records of the second respondent in respect of the orders with No. Nil dated 11.10.2023 and with No. Nil dated 25.10.2023 and to quash the same and consequently to direct the second respondent to restore the ACP and designation of Trained Graduate Teacher to the petitioner with the salary which is attached to the post with retrospective effect form 11.10.2023 and 25.10.2023 with arrears 1/4

This writ petition has been filed challenging the order dated 11.10.2023 thereby placing the petitioner as non teaching staff from the teaching staff.

The petitioner was qualified to be appointed as Teacher. Thereafter, he was appointed in the post of Graduate Teacher in Vivekananda Higher Secondary School. Thereafter, he was appointed as Teacher in the second respondent school on 01.06.2007. While being so, by an order dated 11.10.2023, he was placed as non teaching staff. From the order dated 11.10.2023, the petitioner is working as non teaching staff in the second respondent school. After period of two years, the petitioner challenged the said order, that too having been worked as non teaching staff in the second respondent school. That apart, on perusal of the order passed by the second respondent dated 11.10.2023, it is revealed that the teaching method of the petitioner was not student friendly. Most of the time, the petitioner used to leave the place without any explanation. Therefore, the students were unable to understand Science subject. As such, this Court finds no infirmity or illegality in the impugned order. 2/4

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
