O R D E R
The petitioner, who was arrested and remanded to judicial custody on 24.10.2025 for the alleged offence under Sections 318(4), 61(2) of BNS and 1/7
Section 66D of IT Act, 2000 in Cr.No.59 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that while the petitioner was working as a Branch Manager of HDFC Bank, forwarded various customers' bank account details for the purpose of the commiting on-line scam and also conducting various types of offences including digital arrest. Once these accounts were collected money, he is entitled for 3% commission. The complaint received in this case revealed that Rs.44.15 lakhs were transacted into the bank accounts provided by co-accused in this case. The petitioner reserved commission 3% for the same. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is a Branch Manager and he is custody from 24.10.2025. Though he has shared various bank accounts to the other accused, he has not benefited from any other transactions and was also duped by the other accused. Hence, he prays to grant bail to the petitioner. 2/7
4, The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that as on today (18.11.2025) Rs.80,00,000/- has been illegally obtained from various bank account holders by way of digital arrest and on other on-line scams and funds were routed through the bank accounts introduced by this petitioner and further submitted that so far no amount is recovered in this case and opposed to grant bail.
5. Heard both sides and perused the materials available on record.

Considering the submissions made by both sides and also perused of records reveals that co-accused in this case transferred the funds to unknown accounts, though it is stated that the petitioner has collected 3% commission, statement recorded from him revealed that he has not collected huge amounts as benefit and the petitioner is in custody from 24.10.2025 and the co-accused arrested along with the petitioner already released on bail, hence I am inclined to grant bail to the petitioner, subject to certain conditions;

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned XI Metropolitan Magistrate, Saidapet and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the respondent police at 10.30 a.m for a period of four weeks and thereafter as and when required for interrogation;
[c] the petitioner shall make himself available for interrogation by a Police Officer as and when required; [d] the petitioner shall not directly or indirectly cause any threat to the de facto complainant and witnesses;
[e] the petitioner to give an undertaking that if required for being identified by witnesses during investigation or for police custody beyond the first fifteen days, he shall comply to the directions as may be 4/7
given by the Court in this regard;
[f] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 18.11.2025 Vv Note :
