The petitioner, who was arrested and remanded to judicial custody on 18.10.2025, for the offences punishable under Sections 296(b), 74, 75(2) of BNS, 2023 read with Section 4 of TNPHW Act, in Crime No. 507 of 2025 registered on the file respondent police, seeks bail.

2. The allegation against the petitioner is that he was a driver in a private OLA cab. The victim booked OLA cab and when she was journey in the cab, at that time, the petitioner misbehaved with her by talking dirty things and also molested her. Subsequently, she was returned back for the venue and thereafter, she lodged a complaint after three days i.e., on 17.10.2025 and the petitioner was arrested on 18.10.2025.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide any condition imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the entire incident captured in the audio conversation between them, and the petitioner was also arrested on 18.10.2025. He further submits that investigation is pending and apart from that the petitioner is having five previous cases and one is similar in nature. Therefore, he opposed for grant of bail to the petitioner.

5.Taking note of the fact that the petitioner is having five previous bad antecedents; that the gravity of offence committed by the petitioner; that the investigation is not yet completed; that if the bail is granted to the petitioner, he would indulge in similar type of activities in future, this Court is not inclined to grant bail to the petitioner. 3/4
