O R D E R

This writ petition has been filed to direct the Inspector General of Registration and Chief Controlling Revenue Authority the first respondent herein to dispose the appeal in No.21619/N4/2022 dated 03.08.2022.

2. Mr.U.Baranidharan, learned Special Government Pleader takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that he has purchased an agricultural Punja lands measuring an extent of 3 Acres and 44.5 cents, comprised in S.No.324/1 part, situated at Veera Pandian Pattanam Village,

Thiruchendur Taluk and Thuthukudi District. This being so, the second respondent issued a notice dated 04.05.2022, directing the petitioner to pay the deficit stamp duty together with deficit registration fee at Rs.3,66,785/-, since the third respondent fixed the value of the aforesaid property, as if it is situated in a residential zone. Challenging the said notice, the petitioner preferred an appeal dated 03.08.2022, before the first respondent and the same is still pending. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the first respondent to consider the petitioner's appeal dated 03.08.2022.

5. Learned Special Government Pleader appearing for the respondents submitted that the petitioner's appeal dated 03.08.2022

would be considered and appropriate orders passed, within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case, directs the first respondent to consider the petitioner's appeal dated 03.08.2022 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

With the aforesaid direction, this writ petition stands disposed of. No costs.
