ORDER

The petitioner who was arrested and remanded to judicial custody on 25.08.2025 for the alleged offences punishable under Sections 454, 380 of IPC in C.C.No.190 of 2023 on the file of the District Munsif-cum-Judicial Magistrate, Uthukuli.

2. The learned Government Advocate (criminal side) appearing for the respondent police reiterated the prosecution case and submits that the petitioner is having 49 previous cases similar in nature and he is also a habitual offender. He further submits that P.T. Warrant was also issued for non compliance of the order passed by this Court. He opposed for grant of bail to the petitioner. 3.Earlier this Court granted bail to the petitioner in Crl.O.P.No.24663 of 2025. dated 04.10.2024 and accordingly, he was released on bail. However, he has not complied the conditions imposed by this Court. Hence, the respondent police moved the cancellation of bail, the Trial Court after considering the merits of both sides, cancelled the bail order dated 31.10.2025 in Crl.O.M.P.No. 2577 of 2025. Instead of challenging cancellation of bail order, the petitioner once again seeking for bail in this case. Since the petitioner was already granted bail which was cancelled for non-compliance of the order, the petitioner ought to have challenging the cancellation of bail order and he is not 2 / 4

entitled directly by filing this bail petition. Further, it was also stated by the learned Counsel for the petitioner that the trial is into the stage of examination of Investigating Officer, I am not consider the bail application of the petitioner, this Court is not inclined to grant bail to the petitioner.
