PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, direct the respondents to forthwith disburse the compensation amount of Rs.79,37,145/- (Rupees Seventy Nine Lakhs Thirty Seven Thousand One Hundred and Forty Five only) which has deposited before the Hon'ble Subordinate Judge, Namakkal, vide Cheque No.097589 dated 12.05.2022 under Sections 30 and 31 of the Land Acquisition Act, 1894, in favour of the family of Late Mookaiya Gounder @ Muthusamy, within a time frame fixed by this Hon'ble Court. ORDER
An extent of about 3060 sq.mts in new Survey No.20/3B in Vasanthapuram Village was acquired for the Namakkal by pass project under the Tamil Nadu Highways Act. Pursuant to award no.15/2021-2022 dated 08.11.2021, it is stated that the compensation amount of Rs.79,37,145/- was deposited in the Principal District Court, Namakkal. By submitting a request 2/4
under the Right to Information Act, the petitioner states that it was ascertained that the reference was returned for rectification of defects on 11.10.2022. Since such defects were not rectified till date, the present writ petition has been filed seeking disbursement of compensation.
2. Learned Additional Government Pleader accepts notice for respondents 2 and 3. He submits that the defects would be rectified within two months and that the petitioner may apply thereafter to the Court concerned for disbursement of compensation.
3. By recording the above submissions that the defect would be rectified and the reference would be in order within two months from the date of receipt of a copy of this order, this writ petition is disposed of.
