ORDER

A status report has been filed by the Special Tahsildar, Chengalpattu and the relevant portions are extracted hereunder:- 9.

I respectfully submit that the 2nd respondent herein has no power or authority to revise or correct the award passed by the District Revenue Officer, Kancheepuram, and any such attempt is beyond his jurisdiction. It is pertinent to state that the Divisional Engineer, Highways (Construction and Maintenance), Chengalpattu, who is the 4th respondent in the above writ petition, is the competent authority to revise the compensation relating to the STP. In this regard, it is submitted that the Divisional Engineer has not furnished any revised estimate towards the value of the

structure for the STP separately, even after the joint inspection conducted on 16.04.2025. However, necessary action would be taken by the competent authority, namely, the Special District Revenue Officer (LA), Highways, Chengalpattu, upon receipt of such revised estimate from the Divisional Engineer. 2.

The learned Additional Advocate General appearing on behalf of the 2nd respondent submitted that notice was issued by the 2nd respondent to both the parties and joint inspection was also conducted. The learned Additional Advocate General further submitted that the 2nd respondent cannot deal with the issue for fixation of compensation and it is only the Divisional Engineer, Highways Department, Chengalpattu, who is the competent authority who can pass orders. The learned Additional Advocate General further submitted that after the order is passed by the Divisional Engineer, the amount has to be disbursed by the Special District Revenue Officer (LA), Highways, Chennai. In view of the same, the Divisional Engineer (Highways), Chengalpattu and the Special District Revenue Officer (LA), Highways, Chennai are suo-motu impleaded as the 3rd and 4th respondents in this contempt petition. 3.

In the light of the above stand taken by the Special Tahsildar, there shall be a direction to the 3rd respondent to proceed further with the enquiry as was directed by this Court in the writ petition and pass final orders within a period of six weeks from the date of receipt of a copy of this order. Insofar as

the amount determined towards payment of compensation to the petitioner, the said amount shall be paid by the 4th respondent within a period of two weeks thereafter.

With the above directions, this contempt petition is closed. No costs.
