O R D E R
The petitioner, who was arrested and remanded to judicial custody on 24.10.2025, for the alleged offence punishable under Section 5(j)(ii) r/w 6 of POCSO Act, 2012 in Crime No.33 of 2025, on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner is the neighbour of the victim girl aged about 16 years. It is alleged tha,t taking 1/4
advantage of the victim's age, he committed aggravated penetrative sexual assault, which resulted in causing pregnancy. It is further alleged that the victim was taken to the hospital, due to illness, and it was revealed that the petitioner committed aggravated penetrative sexual assault. Hence, the complaint was lodged, and the petitioner was arrested and is in judicial custody.
3. Learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 24.10.2025 and due to property dispute, he has been falsely implicated in this case. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation is still pending. He also produced the statement of the victim girl in support of the prosecution case. However, he opposes to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. On perusal of the FIR and the statement of the victim girl, it is seen that various disturbing facts including that the petitioner had forcibly committed aggravated penetrative sexual assault, which resulted in causing pregnancy.
7. Considering the above facts, the submissions made by the learned counsel on either side and the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner. 2/4
