The petitioners, who was arrested and remanded to judicial custody on 17.10.2025, for the alleged offence punishable under Sections 126(2), 296(b), 115(2), 311, 351(3) of BNS, in Crime No.301 of 2025, on the file of the respondent police, seek bail.

2. The allegation against the petitioners is that the petitioners are ranked as A3 and A2 respectively. They waylaid the defacto complainant and attacked the defacto complainant and robbed a sum of Rs.6,100/- and also mobile phone. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioners were arrested purely on suspicion and that they have not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioners are having two previous cases against them and the money was also not recovered. Hence, he opposed to grant anticipatory bail to the petitioners. 2/6

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the fact that the petitioners were arrested on 17.10.2025 and that the petitioners are having bad antecedents, at this stage, if the petitioners are released on bail, they may involve themselves in similar activities, therefore, this Court is not inclined to grant anticipatory bail to the petitioners. 3/6
